1. Acceptance of Terms

By downloading, installing, or using the Athly application (hereinafter, "the Application"), you agree to be bound by these terms of use. If you do not agree with these terms, do not use the Application.

2. Service Description

Athly is an iOS mobile application designed to help athletes (runners, trail runners, and triathletes) to:

• Manage upcoming sports events
• Record race results
• Track athletic performance
• Organize competition information

3. Usage Requirements

3.1 Eligibility

• You must be at least 13 years old to use the Application
• You must provide accurate and complete information when required
• You are responsible for maintaining the security of your device

3.2 License to Use

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application exclusively for personal and non-commercial use.

4. User Account and Data

4.1 User Responsibility

• You are responsible for all information and data you enter into the Application
• You must maintain the accuracy of entered data
• You are responsible for any activity that occurs on your device

4.2 Data Storage

• Event and result data is stored locally on your device
• If you enable iCloud, some data may sync through Apple's servers
• We are not responsible for data loss due to device failure or accidental deletion

5. Privacy

5.1 Information Collection

The Application may collect:

• Sports event information entered by the user
• Results and performance statistics
• Application preferences
• Anonymous usage data to improve the service

5.2 Use of Information

• Your personal information is NOT sold or shared with third parties without your consent
• Data may be used to improve Application functionality
• You may request deletion of your data at any time

5.3 Third-Party Services

If the Application integrates with third-party services (such as Strava, Garmin, etc.):

• You agree to the terms of service of those services
• Sharing data with these services is optional and requires your explicit authorization
• We are not responsible for the privacy practices of third-party services

6. Acceptable Use

6.1 PROHIBITED Activities:

• Using the Application for illegal activities
• Attempting unauthorized access to systems or data
• Distributing malware or harmful content
• Reverse engineering, decompiling, or disassembling the Application
• Using the Application in a way that could damage or overload our services
• Copying, modifying, or distributing the Application without authorization

8. Disclaimer

• The Application is provided "AS IS" and "AS AVAILABLE"
• We do not guarantee that the Application will be error-free or uninterrupted
• We are not responsible for decisions made based on information from the Application

8.2 Sports Information

• The Application does NOT provide medical or professional training advice
• Consult with medical professionals before starting any training program
• We are not responsible for injuries or damages related to use of the Application

8.3 Data Accuracy

• We do not guarantee the accuracy of calculations, statistics, or displayed information
• The user is responsible for verifying the accuracy of entered data

9. Limitation of Liability

To the maximum extent permitted by law:

• We will NOT be liable for indirect, incidental, special, or consequential damages
• We will NOT be liable for loss of data, profits, or revenue
• Our total liability will not exceed the amount paid for the Application (if applicable)

10. Service Modifications

10.1 Changes to the Application

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Application
• Update these terms of use at any time
• Change or remove functionality with or without prior notice

• The Application may download updates automatically according to your device settings

• The Application requires iOS 17 or higher
• We do not guarantee compatibility with devices or iOS versions not officially supported

13. Jurisdiction and Applicable Law

These terms are governed by the laws of Spain, without regard to its conflict of law provisions.

13.2 Dispute Resolution

• Any dispute related to these terms will be resolved through good faith negotiation
• If resolution is not reached, disputes will be submitted to the competent courts of Spain
